The focus of this program will be a discussion of COVID-19 influenced and related litigation, specifically on enforcement and defenses to compliance with contractual obligations. Recognized by Chief Justice C. J. Seitz as relevant topics that lawyers in Delaware need to know, we offer this CLE. The Delaware primary trial courts, the Court of Chancery and the Superior Court, as well as the United States Bankruptcy Court for the District of Delaware, have been experiencing a significant increase in litigation surrounding the effects of the pandemic on contractual rights, obligations and defenses to performance.
